юр, политПраво индивида решать личные дела без государственного вмешательства [invasion of privacy] и контролировать распространение информации о себе. Относится к числу естественных прав [natural law], однако общепринятого правового определения этого понятия не существует. Конституция США [ Constitution, U.S.] прямо не упоминает это право, но Верховный суд [ Supreme Court, U.S.] в ряде решений признал, что оно входит в сферу действия Первой, Четвертой, Пятой, Девятой и Четырнадцатой поправок [ First Amendment; Fourth Amendment; Fifth Amendment; Ninth Amendment; Fourteenth Amendment] к Конституции. В частности, Девятая поправка гласит: "Перечисление в Конституции определенных прав не должно толковаться как отрицание или умаление других прав, сохраняемых за народом", что дает основание Конгрессу и Верховному суду прямо упоминать эти "другие права". В 1974 Конгресс в Законе об охране прав личности [ Privacy Act of 1974] впервые установил, что частное лицо имеет право знакомиться с информацией о себе, содержащейся в досье государственных ведомств, а также оспаривать содержащуюся там информацию и вносить в нее поправки и изменения. Верховный суд США в своих решениях по некоторым делам ([Cohn v. Cox Broadcasting Co., Griswold v. Connecticut, Mitchell v. United States, Olmstead v. United States, Roe v. Wade]) отнес к таким правам право на конфиденциальность телефонных и иных разговоров, право пользоваться противозачаточными средствами и право женщины на аборт, а также запретил публикацию имен жертв изнасилования. По умолчанию к ним относятся право на неприкосновенность жилища, документов и имущества и запрет на необоснованные обыски и аресты (Третья и Четвертая поправки), право на защиту от самооговора [self-incrimination; см self-incrimination clause] (Пятая поправка) и другие права. Однако развитие определенных общественных потребностей, как например, развитие социального и медицинского страхования, требуют создания банков данных о гражданах. Последнее приводит к определенным ограничениям права на неприкосновенность сферы личной жизни, что и признано как в Законах, принятых Конгрессом, так и в решениях Верховного суда. Новый аспект этой проблемы - использование компьютерной информации как угроза частной жизни ([Computer Safeguards Act of 1988]). Весь вопрос продолжает оставаться предметом споров как юристов и законодателей, так и рядовых граждан. -
